The Difference Between a "Fee Simple Estate" and a "Split Estate"?

The purchase of property can be a wonderful and exhilarating experience. Purchasing property, whether large or small, is a huge part of fulfilling what we call "The American Dream." For most people this type of transaction is relatively simple, for others it can become a little more complicated.

Those looking to purchase many acres of land or people looking at ranches for sale may have to consider the mineral rights of the property in which they are interested. In considering mineral rights they will need to become well-versed in the difference between a "fee simple estate" and a "split estate."

First we will discuss the "fee simple estate." In most countries, all mineral resources belong to the government of that country. Since these commodities belong to the government, it is not legal to extract and/or sell anything below the surface of the ground. Government authorization is required to extract any type of mineral. This was not always the case. Prior to commercial drilling and mining, ownership of mineral resources was granted to the person or organization that owned the surface. The person or organization had both surface and mineral rights. This complete private ownership is called a "fee simple estate." This is, of course, the simplest type of ownership. The person or organization has complete control of the surface, subsurface and the air above the surface.

Secondly, in "split estate" situations the surface rights and the rights to extract subsurface minerals are owned by different parties. How does this type of situation develop? Perhaps a commodity is discovered below a certain property. The "fee simple estate" owner can sell the rights to the subsurface commodity while retaining rights to the surface of the property. Why would a company be interested in the subsurface only? The company interested in purchasing mineral rights may be interested in extracting and selling the commodity but may not want the extra expense of purchasing the rights to the surface.

When a company purchases the mineral rights of a property it also buys the right to enter the property for the purpose of removing that mineral at a future time. However, the mineral owner must show regard for the interests of the surface estate owner and occupy only the portions of the surface that are necessary to develop the mineral.

Laws relating to surface and mineral rights and/or the transfer of these rights vary from state to state. If you are considering purchasing a large amount of property it would be a good idea to become familiar with these types of ownership. Any question about these laws should be brought to the attention of an attorney who can fully explain them.

In summary, a "fee simple estate" owner has complete control of the surface, air or any mineral below the surface of the ground. The owner has complete mineral rights. In "split estate" situations, one party has rights to the surface and another party has rights to extract subsurface minerals. In these cases the mineral owner must show regard to the interests of the surface owner and compensate them for disruption to the land.

If the worker is generally involved in paper orientated tasks, such as an accountant would be, then desks need to have plenty of room.

List Building 102 - What to Do Once You Have Your Squeeze Page Set Up

So in List Building 101, you learned about how to start a list, and the basic steps necessary to make that happen.

So what do you need to do now that you have your squeeze page up and an opt in form on that page?

One of the most important things is getting traffic to your squeeze page. If there is no traffic, no matter how well you have set up your squeeze page, you are not going to build your list.

Now, I am a proponent of building quality traffic, even if it takes a little longer to build, rather than buying junk traffic or doing free advertising. Now, don't get me wrong, I use free traffic sources, I just don't do free advertising.

There are two primary, free, high quality traffic sources that I believe in very strongly.

1) Natural search engine results. There are many things that you can do to get high natural search engine results. The first step is to minimally optimize your web page for the keywords for which you want to get to a top ten results ranking. Now, if your keyword is real general and there are 10 million competing web sites, you are probably not going to get a top ten result. But, if you narrow down your keyword choice, and make it more specific, for example, going from fishing to deep sea fishing, where there are far fewer web sites competing for number one, then you have a much greater chance of making something great happen.

The second step is to submit your web site url to at least 100 web directories. You may think that is over kill, but let me ask you this - would you rather do half the work and get to #11, or do all the work and get to #1 or #3?

The third step is to write an article using your keyword and send it to at least one hundred article directories, with a text anchor link back to your web site.

3) Article marketing. Now this varies from step three of number 1, in that you are going to write multiple articles and submit them only to the top 5 or 6 article directories online, and only article directories that have pageranks of at least 6 or 7. This will create massive pre-sold traffic to your web site, from direct web visitors who come to your web site after reading the article online.

PayPal's Return Policy and Its Significance to Digital Product Merchants

One of the only concerns I had in dealing with DigiResults was that I would be in charge of granting refunds (DigiResults themselves will issue the refund to the customer if you give them the greenlight to do so) to any customers who are dissatisfied with the quality of my product. That means more freedom but more work for me as I had to play judge with every new requested refund.

I mention this because I recently came across something interesting which relates to any digital product merchants (like me) who use an affiliate network like DigiResults or any instance where PayPal is involved for transferring money in part; something which all merchants should be aware of. I'm referring to PayPal's dispute policy as it pertains to digital products.

In their "what items are not covered under buyer protection section", they make it clear that "there are some payments that we do not cover including... most intangible items". Intangible items refers to a number of things which includes digital products and services.

What this means is that you (the merchant) are not liable or obligated to offer a refund on your digital product because digital products are not covered by PayPal's refund policy.

This also means that disreputable merchants could use this in their favor to give disgruntled customers the cold shoulder time and time again without repercussion.

This is just something for you to be aware of. That being said, the best thing to do is to establish a return policy which you can mention on your sales page to help encourage sales and stick to and follow it by the letter through all complaints whether that means approving or denying a refund.

And remember that while you're not liable or obligated to grant refunds in that scenario, people can still write nasty and discrediting things about you and your product online which can have an adverse affect on future sales/customers, so it's just something to keep in mind that it's in your best interest to again be as fair and just as possible when it comes to refunds.

Lastly, remember that the one caveat of this is that the customer can still file a credit card dispute if they used that card for the purchase. These disputes can be investigated like any other, and if you have evidence that the customer broke the terms of your refund policy (hence having your refund policy written specifically in a special section), then the customer won't have a leg to stand on, let alone a case against you.

The Most Powerful Attribute in Antiques and Collectibles

What can increase your sales volume and make you more productive day in and day out? You've probably heard this three word statement that separates those who wish they could do better,from those who really do.

Knowledge is power!

This three word statement is more than just a great philosophy. The more knowledge you have about antiques, the higher the increase in your overall profitability...as long as you use that knowledge. Knowledge can literally make or break your antique business.

Here's a difficult lesson that was taught to a high-minded museum by a shrewd, savvy antique buyer with knowledge.

I love this story! It vividly illustrates the difference between knowing and being in the dark about antiques and their value. I was browing in an antique shop a number of years ago, when I struck up a conversation with the owner. We talked about incredible finds that we had stumbled across over the years. Her story topped anything that I had ever done...hands down!

It all started when she attended the last day of a weekend sale at a local museum. It seems that the museum was desiring to remodel, and they were attempting to raise needed funds by selling off some antiques that had been found in the carriage barn that stood on the property. Obviously, she was not expecting to see anything spectacular because she assumed that the sale would be "cherry-picked".

And then it happened!

While walking through the sale, she discovered a large painting with a faded gold frame. Something about the painting looked strangely familiar, and she thought to herself, "I've seen that in a history book somewhere."

She quickly ran to her vehicle and poured over several large painting identification books that she had brought with her from her personal library. After taking 10 minutes to research, she was almost positive that this painting was a rare item indeed. She went back inside, and with a few minutes left in the sale, she wrote a personal check for $125. and loaded it into her station wagon.

Life took a sudden and drastic turn...for the better!

Upon arriving home, she began to dig deeper with her research tools. She "burned the midnight oil", and as morning broke, her heart was beating faster as she came to the realization that this painting was something very special.

The next morning, after more phone calls and cross-checking, she gingerly loaded the painting and took it to a temperature controlled vault in the same city where she urchased it. This $125. painting later sold for several million dollars at a major auction house, and this woman's financial future was changed in dramatic fashion literally overnight.

The museum curator was appalled, overwhelmed and completely flabbergasted!

Imagine that you are the curator of this museum, and you placed the $125. price tag on this million dollar painting! This tag sale had been held to raise money for projects around the museum. If the curator had only possessed the knowledge to even "check it out", the outcome could have been far more positive for the establishment that he represented!

Knowledge and research made all the difference.

Aside from the curator, think of all the antique dealers, collectors and enthusiasts that had toured this weekend-long tag sale. Here was an item that could change their entire lives financially, and they walked right on by. any one of them could have sold the painting, banked the money, and just "fiddled" around with antiques instead of trying to make a living from them. And the difference was knowledge!

How to get antique knowledge.

With the advent of the Internet, research is easier to do, and the knowledge is much easier to come by. There are literally hundreds, if not thousands of sites that are dedicated to various collectibles, art and antiques.

Visiting the library all day, once a month can be one of the best ways to increase your knowledge of antique items. The library is still one of the most untapped resources for gaining expertise on a variety of antique subjects. Talk to the librarian, ask questions, and dig! The human mind is like a sponge, and someday you may need what you are learning today.

A methodical approach toward research and gaining knowledge can pay huge dividends in your antique world. It's the secret that can make a huge impact in the buying decisions that you make!
